Main contract details
The approach to procurement shall be a two stage tender process. This first stage shall comprise competitive tenders based on priced preliminaries, overhead and profit recovery and pre-award services, together with qualitative appraisal.
Following submission and assessment of the first stage tenders, a single preferred contractor will be selected to fully engage in the second stage process and to carry out the pre-award services leading to establishment of a firm, fixed price and the subsequent contract award.
During the second stage, the contractor shall work with the client’s advisers in the development of the detailed design and advise the team on all matters of buildability, cost and programming. This must be recognised as a significant role for the contractor and he must provide appropriate and adequate resources for this role. The costs, if any, for providing this role are to be included within the contractor’s tender as part of the pre award services.
During the second stage, sub-contracted elements of the work will be competitively tendered on an “open book” basis with all quotations assessed and analysed jointly by the contractor and the client’s advisers. The contractor shall prepare a formal and written tender report for each and every tendered sub-contract, and issue to the client’s cost manager, with the process culminating in the selection and subsequent appointment of sub-contractors by the contractor.
On agreement between the parties for a firm fixed price, a programme and a method of working, all to the satisfaction of the client, the contractor will be appointed under the JCT Design and Build (DB), 2011 Edition, incorporating Amendment 1, March 2015. Contracts will not be exchanged and work will not start before a firm, fixed price has been established.
