Main contract details
The Mental Capacity Act (MCA) DoLS provide protection for vulnerable people who are accommodated in hospitals or care homes (referred to as managing authorities) in circumstances that amount to a deprivation of their liberty, and who lack the capacity to consent to the care or treatment they need. In such cases, MCA DoLS provide a lawful way to deprive someone of their liberty within the meaning of Article 5 of the ECHR, provided that this is determined to be in their best interests and the less restrictive option in order to keep them safe from harm.
The purpose of the Paid Persons Representative (PPR) is to act in a professional capacity to fulfil the Relevant Person’s Representative role in relation to a specified relevant person for the period their deprivation of liberty is authorised under what is referred to as a standard authorisation.
The proposed Framework Agreement will be for an initial period of 3 years to commence on 7th July 2025, with an option to extend, subject to satisfactory performance outcomes and agreement by the Authority, for a further period, or periods, up to a total of 1 year, taking the Framework term to a maximum of 4 years up to 6th July 2029. The proposed service is based on current and known funding allocations. These could alter through the life of the contract in light of changes in future local and central government funding. The Framework Agreement value assigned to this service is £200,000 per annum, £800,000 for the full 4 year framework period. The Authority is conducting this procurement under the Light Touch Regime for Social and Other Specific Services, as set out in the Public Contract Regulations 2015 (PCR), at Section 7 (Regulations 74 to 77). The Procurement process will be similar to that of an Open Procedure however, the Process will, unlike an Open Procedure, include the flexibility, as allowed under the Light Touch Regime.
It is the Authority’s preliminary view that TUPE is unlikely to apply in respect of this Contract.
