Main contract details
An agreement made under Section 106 of the Town and Country Planning Act 1990 (as amended) which relates to the project includes within Schedule 1 (Halite’s Covenants) a requirement for Halite to obtain WBC’s Approval for a Decommissioning Scheme Fund Plan (Part 3 of Schedule 1).
The developer – Halite Energy Group – has submitted various documents (attached) pursuant to the requirement to seek approval of the Decommissioning Scheme Fund Plan.
The Council has rejected the Decommissioning Scheme Fund Plan.
Wyre Borough Council would like advice in respect of the following:
1. Whether, for each and all stages of development, the Decommissioning Scheme Amount identified will provide WBC with access to sufficient funds to carry out works in accordance with schemes approved under Requirements 31 (Decommissioning, restoration, and aftercare scheme for submission prior to commencement of the authorised development), 32 (Decommissioning of individual operational caverns during operational phase), and 33 (Decommissioning, restoration, and aftercare scheme after permanent cessation of operations) of Schedule 9 of the DCO.

2. Whether WBC should approve the submitted Decommissioning Scheme Fund Plan – ie was the rejection justified or not? If it was justified then what further information/details should the council; require the developer to submit as part of a revised Decommissioning Scheme Fund Plan?
3. Reasoned explanations for any response to 1. and 2. above.
A response to the Council should include details of:
1. The method of analysis etc. to be used to answer the questions and to provide the advice sought.
2. The overall fee to be charged and how this is broken down by proposed hourly rate and number of work hours.
3. The qualifications and relevant experience of those proposing to carry out the work.
The Council will consider submissions on the basis of ‘best value’, however, the Council is not obliged to accept any quote.
